1) Agreement to These Terms
These Website Terms & Conditions ("Terms") govern your access to and use of our website, online forms, scheduling tools, content, text messages, emails, calls, and other online services provided by Southern Crawl Space Repair, LLC ("Southern," "we," "us," or "our"). By using our website or submitting information to us, you agree to these Terms. If you do not agree, do not use the website or online services. These Terms are website and online-use terms. They do not replace the written proposal, service agreement, payment terms, project terms and conditions, warranty schedule, notice of cancellation, or change orders that apply to a specific customer project. If there is a conflict between these Terms and a signed project agreement, the signed project agreement controls for that project.
2) Eligibility
You must be at least 18 years old and have authority to request information, schedule an appointment, or enter into a contract for the property involved. By using the website or submitting a request, you represent that the information you provide is accurate and that you are authorized to provide it.
3) Website Information, Estimates, and Services
3.1 General Information Only: Website content is provided for general information about crawl space repair, crawl space encapsulation, moisture control, vapor barriers, drainage, sump pumps, dehumidifiers, insulation, mold/fungal treatment, cleanouts, inspections, maintenance, and limited structural wood repair. Website content is not engineering advice, legal advice, environmental advice, medical advice, or a guarantee that any specific service is appropriate for a particular property.
3.2 Estimates and Pricing: Any online estimate, price range, discount, offer, financing example, or service description is informational only and is not binding unless included in a written proposal or service agreement approved by Southern. Final pricing and scope depend on inspection findings, site access, property conditions, selected products, customer decisions, permits, third-party trade work, and other factors.
3.3 Written Project Agreement Controls: Specific work is governed by the written proposal or service agreement accepted for that project. Southern is not obligated to perform work, honor a price, provide a warranty, or include a product or service unless it is included in the written project agreement or a written change order.
3.4 Service Area and Availability: Service availability depends on location, scheduling capacity, site conditions, and licensing or permitting requirements. We may decline or reschedule work when conditions are unsafe, outside our scope, outside our service area, or otherwise impractical.
3.5 No Emergency Services: Website forms, emails, text messages, and online scheduling tools should not be used for emergencies. If you believe there is an immediate risk involving gas, electrical hazards, flooding, sewage, structural failure, fire, or personal safety, contact the appropriate emergency service, utility provider, or licensed professional.
4) Communications Consent
4.1 Calls, Emails, and Appointment Communications: By providing your contact information, you authorize Southern to contact you about your inquiry, inspection, appointment, estimate, project, account, warranty, maintenance, or related services by phone, email, text message, voicemail, or other reasonable communication methods.
4.2 Text Messages: If you provide a mobile number, you consent to receive service-related text messages about scheduling, appointment reminders, project updates, follow-up, payment, maintenance, and service communications. Message frequency may vary. Message and data rates may apply. You may reply STOP to opt out of non-essential text messages or HELP for assistance. Consent to marketing text messages is not required as a condition of purchase and will be obtained where required by law.
4.3 Call Recording: Calls may be recorded or monitored for quality assurance, training, documentation, customer service, and dispute resolution where permitted by law. By calling us or accepting our calls, you consent to such recording or monitoring where allowed.
4.4 Photos and On-Site Documentation: Southern may take photos, video, notes, measurements, sketches, or other documentation during inspections, estimates, service visits, installations, maintenance visits, or warranty reviews for estimating, project documentation, training, quality control, safety, warranty, and dispute-resolution purposes. Southern may use project photos or videos for general education, training, website, social media, or marketing purposes when the image does not identify the customer, the property owner, the property address, the exact location, people, license plates, house numbers, mailboxes, street signs, personal items, or other identifying details. Southern will obtain separate permission before using images that reasonably identify a customer, home, property, project location, or individual person.
5) Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the website, submitting forms, or communicating with us, you acknowledge that your information will be handled according to our Privacy Policy (https://southerncrawlspacerepair.com/privacy-policy).
6) Intellectual Property
The website and its content, including text, graphics, logos, photographs, videos, design, layout, service names, and other materials, are owned by or licensed to Southern and are protected by intellectual property laws. 7) User Conduct

violates any law or regulation;

interferes with website security or operation;

Those third parties are responsible for their own content, services, terms, privacy practices, security, and performance. 9) Website Disclaimers

To the fullest extent allowed by law, Southern disclaims all warranties relating to the website and online services, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted or error-free operation. 10) Service Warranties
Warranties for specific customer projects, if any, are stated only in the applicable written proposal, service agreement, warranty schedule, product warranty, or written change order. Website descriptions, blog posts, FAQs, advertising, photos, videos, or verbal statements do not create additional warranties. No service warranty applies unless expressly stated in the written project documents.
11) Limitation of Liability
To the fullest extent allowed by law, Southern will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the website, online services, website content, third-party links, communications, or information submitted through the website. This includes lost profits, lost data, business interruption, loss of use, or similar damages, even if Southern was advised of the possibility of such damages. For claims related to a specific customer project, the limitation of liability in the signed project agreement controls. For website-only claims, Southern’s total liability will not exceed $100 or the amount you paid directly to Southern for the website-related service at issue, whichever is greater, unless applicable law requires otherwise.
12) Indemnification
You agree to defend, indemnify, and hold harmless Southern, its owners, officers, employees, agents, subcontractors, vendors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the website or online services, your submission of false or unauthorized information, or your violation of any law or third-party right.
13) Changes to the Website and Terms
Southern may update, change, suspend, or discontinue any part of the website, online services, content, offers, or these Terms at any time. Changes are effective when posted unless otherwise stated. Your continued use of the website after changes are posted means you accept the updated Terms.
14) Governing Law
These Terms are governed by the laws of North Carolina, without regard to conflict-of-law rules, except where the laws of another state must apply to services performed in that state. Any dispute relating solely to the website or these Terms shall be brought in the appropriate state or federal court with jurisdiction over the dispute, unless a signed project agreement provides a different dispute-resolution process for a customer project.
15) Severability and Waiver
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. Southern’s failure to enforce any provision is not a waiver of its right to do so later.
16) Entire Agreement for Website Use
These Terms and the Privacy Policy are the entire agreement between you and Southern for use of the website and online services. They do not replace or modify any signed project agreement, proposal, warranty schedule, payment terms, notice of cancellation, or change order for specific work.
